Some comments are uneducated the Charter of Rights and Freedoms Section 8 protects property from search and seizures and government officials act fairly and reasonable so there's City bylaws do not Trump the rights of the Charter of Rights and Freedoms which is the supreme law

They can justify the cost of demolition because it will just be added to the residents tax bill. This may seem wrong, but honestly every municipality has bylaws to follow. If I build a fence or building, deck or renovation with no permit I will also get fined and possibly have to take it down if I don't comply. Perhaps some type of agreement could have been made here, but it really should not be a big surprise that it ended up like this.

Seaman said it himself… “most people back down”. Here we have a non elected bureaucrat using his position of power to squash people under his thumb just so he can feel big and important. Well, Mr. Ross did not back down so now Seaman has a vendetta against him to make him pay for hurting his feelings. As far as the cost of demolishment, I’d guess the price quoted would more than cover complete replacement including piping and electrical.

My comment is going to be unpopular, but you have to respect the permitting process. And, if I was a neighbour, maybe I wouldn't appreciate seeing the rink. Go practice at a public arena. If he lived on a farm, the rink is fine. But, a big massive rink doesn't entirely respect other neighbours. Are big movie projector screens acceptable parts of a backyard? Basketball courts (bounce, bounce, bounce), tennis courts? Go-Kart tracks? Stand-up comedy podiums? Bars? Nudist clubs? Cricket fields? Golf driving ranges? Gymnastic equipment like high beams? Skateboarding half pipes? I get it. The rink is for his kids. Its nice he did that. He's a great dad. But, if you are living in close proximity to others, it matters what they want too. Personally, I like my backyard quiet and peaceful. Children playing, construction work and dogs barking is tolerable. However, a rink is a potential precedent for other crazy things people want to build. Most commenters probably haven't considered that.

ppl!!! please read court documents & verdict before taking sides. this guy applied for all the benefits of a heritage house for decades and suddenly cut trees (part of the heritage policy) and puts a rink in the yard. It clearly doesnt fit heritage definition and he was given tonnes of warnings throughout the year. So, no sympathy to this guy.

When this man bought in a designated heritage area, he esentially bought the equivalent of a condo with condo rules. He knew he wouldn't get approval but went ahead hoping nobody would do anything but it has backfired on him. Heritage area rules are strict and I bet neighbours who have done work went through a lengthy and expensive process to make sure what they renovated or built met heritage rules.
